They seem to be missing some details, like the fact that the trailers were based on scripted non-procedurally generated material and literally cannot occur in the actual game. Also, they state that the claims against No Man's Sky aren't easily defined yet many features are exactly defined as a simple yes or no, like online play. So what if they can't prove customers purchased the game based on these individual expections? They can't prove customers purchased an Nvidia graphics card because of an extra 0.5gb of RAM or Killzone because of 1080p graphics either.

How does that even imply proper multiplayer? MGS3 on the PS2 had the ONLINE FEATURES -symbol, because you could download camos or something online. It doesn't mean it's a full fledged multiplayer game.
