All that's required for a tracker to be private is that you need an account to download torrents, and you can't create multiple accounts. Arguably open signups don't really count as private, but WCD does not have open signups so it's all good.

I've fucked with pre retail stuff a lot in the past. The problem here is that he put it on torrents. He obviously didn't leak all the screeners last year, someone did the others. He made himself easy to find though so they are indeed making an example of him, like they did many others before. He should have put some distance between himself and the upload. Being in a scene group could have helped if the marks wouldn't come directly back to him. Remember OBUS and that coveted Lord of the Rings VHS screener? The guy got fucked because he was traced to his source. This guy sounds like he was snatching screeners off the Paramount lot which he could have got away with if they didn't find out he was the original source on ptp.

It's not an unreasonable thought to have. Magnet links don't contain infohashes or other metadata, they just expect the client to use DHT to gather that information from others.
Apparently there's a field in magnet links that lets you specify a link to download the normal torrent file from and use it instead, and that's what these private trackers are doing.

I did one with pretty much no effort just answering relatively honestly short answers for each question and they were about to invite me, before they realized the email was tied to an old account that I forgot about that I'd created when the site was in open registration, so they just re-enabled that instead.
