The show wasn't owned by Nintendo, but the characters in it are. Not sure how this applies legally, but obviously since this was allowed to happen in the first place, I'd assume that the fact that the show is owned by DiC takes priority over the ownership of the characters in it by Nintendo.
I'm still gonna bet Nintendo are gonna file a lawsuit at either DiC or Valve for this happening, which might be interesting to see how that would turn out, especially considering the mere thought of Nintendo facing Valve in a courtroom.

I'd imagine that they have to seek Nintendo's permission to renew the license or something, or give them a royalty check.
These old cartoons were re-released on DVD collections a few years ago, and same deal with Sega and Sonic, meaning there is a legal situation that isn't readily apparant at the base level for most people.
