Youtube uses webm in it's html 5 player.
Saying webm isn't being used alot, while the biggest video sharing site supports it, is just simply wrong.

Because VP8/VP9 don't have readily available hardware acceleration, meaning that for most people playing WebMs is done with the CPU with a software decoder, heating the machine up and gulping down battery like crazy.

H.264 playback on the other hand is hardware accelerated in damned near every device made since 2008 and can be done extremely efficiently.

Apple's most popular products are mobile: iPhones, iPads, Macbooks. Battery life is a huge priority for them. It makes perfect sense that they have little interest in supporting something that most devices can't do in an efficient manner.

You're not wrong, but that's not something consumers care about. What consumers DO care about is when watching youtube cuts their laptop's battery life in half for no apparent reason.

Latest Snapdragons are now able to decode 4k h.265/VP9 (and soon AV1) 60fps.

That only works going forward. VP8/VP9 would still need to be disabled on old devices.

Except it is. HEVC is the codec for UHD Blu-ray and will succeed H.264 as the de facto video codec for all consumer video.

AV1 is just Google trying to force its way into a fight with MPEG via YouTube. It is the HD-DVD of next-gen video codecs. No one else gives a shit.

Your "free" codec has an Achilles Heel.
The promoters have agreed not to charge for or litigate about the use of their codec.
But they have not offered any protection/compensation if their codec is shown to infringe someone else's IP. All users would be exposed.
There are so many patents in this area that are totally unknown. These so-called "submarine" patents can surface once the number of infringing users reaches a level where litigation becomes a viable revenue source.
