No loopholes were taken, the Whitehouse wrote a letter essentially saying 'we don't believe it's legitimate so we're going to ignore it', which is not a legally viable defense. To combat a warrant you don't write the police a letter saying 'I don't recognise your warrant is legitimate so I'm going to keep my door locked', you have to appeal it formally.

The media reporting on these polls was the most significant factor in how people recieved said data, because anyone even passing their eyes down the list with any understanding of polls would be noticing that their error margins being mostly larger than their difference showed it was anyone's election, not just somewhat close, but that isn't how the media reported it. The only thing I can conclude is that Left leaning media aimed to discourage republicans from voting by insinuating the race was lost, and it backfired because they didn't manage to get their message far enough into battleground states.
